These Terms of Use are entered into by and between you and Sam Consulting & Training B.V., trading as Sam's Coaching Corner ("Sam's Coaching Corner," "we," "us," or "our").

These Terms of Use, together with any documents they expressly incorporate by reference (including our Privacy Policy), govern your access to and use of samscoachingcorner.com (the "Website") and the content, functionality, and services offered on or through the Website, whether as a guest or a registered user.

Please read these Terms of Use carefully before you start using the Website. By using the Website, you accept and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not access or use the Website.

This Website is offered and available to users who are 18 years of age or older and able to form a legally binding contract. By using this Website, you represent and warrant that you meet these requirements. If you do not, please do not use the Website.

The information on this Website (including blog posts, articles, and downloadable resources) is provided for general information and reflection only. It is not intended as, and must not be relied upon as, legal, financial, tax, medical, psychological, or any other professional advice.

Coaching offered through Sam's Coaching Corner is not therapy and not psychological care. We are not psychologists or licensed mental health practitioners. If you are dealing with trauma, grief that requires deeper support, mental health symptoms that belong in clinical care, or any other concern requiring professional treatment, please consult a qualified therapist, doctor, or other appropriate professional.

8. Personal responsibility — no guarantees

You accept personal responsibility for the results of your actions taken in connection with using the Website or any services we provide. We make no guarantees about the outcomes of coaching or about results you may achieve by applying any information provided. Your results depend on your own efforts, circumstances, and many other factors outside our knowledge or control. Prior results of other clients do not guarantee similar outcomes for you.

9. Coaching services

Coaching services purchased through this Website are governed by a separate Coaching Agreement that we will provide before any paid engagement begins. The Coaching Agreement sets out specific terms for that engagement, including session cadence, payment, cancellation and rescheduling, and confidentiality. These Terms of Use govern only your use of the Website itself.

10. Email and electronic communications

By visiting the Website or sending us emails, you consent to electronic communications. We will take reasonable steps to keep communications confidential, but no internet transmission is fully secure. Please do not send sensitive or confidential information by unencrypted email.

11. Links to third-party websites

The Website may contain links to third-party websites (for example, LinkedIn Learning, scheduling tools such as Calendly, video conferencing tools, or payment processors). These sites are not under our control, and we are not responsible for their content, privacy practices, or policies. We provide these links for convenience only. The inclusion of any link does not imply our endorsement of that site.

12. Materials you provide to us

We do not claim ownership of any feedback, suggestions, comments, or other materials you submit to us ("Submissions"). To the maximum extent permitted by law, Sam Consulting & Training B.V., its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Website, any content on it, or any services obtained through it — whether based on contract, tort, negligence, or any other legal theory.

If, despite the above, we are found liable, our total liability for all claims relating to the Website or these Terms is limited to the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or €100, whichever is greater.

Nothing in these Terms limits any liability that cannot legally be limited, including liability for death, personal injury caused by negligence, or fraud.

15. Indemnification

You agree to indemnify and hold harmless Sam Consulting & Training B.V. and its directors, employees, and contractors from any losses, costs, liabilities, and reasonable legal fees arising out of your use of the Website, your breach of these Terms, or your violation of any law or third-party right.

16. Governing law and jurisdiction

These Terms of Use are governed by the laws of the Netherlands, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or your use of the Website will be submitted to the exclusive jurisdiction of the competent Dutch courts, unless mandatory consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts.

17. Severability

If any provision of these Terms is found by a competent court to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.

18. Entire agreement

These Terms of Use, together with our Privacy Policy and (where applicable) any Coaching Agreement we enter into with you, constitute the entire agreement between you and Sam Consulting & Training B.V. regarding your use of the Website, and supersede all prior agreements or understandings on the subject.
